  1. ACCEPTANCE OF THESE TERMS

These Terms and Conditions ("Terms") govern your use of the website at www.allstarcoatingstx.com (the "Site") operated by All-Star Coatings, LLC. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to use of the Site only. Coating services we perform for you are governed by a separate written quote, proposal, or service agreement we provide before work begins.

  1. WHO WE ARE

The Site is operated by All-Star Coatings, LLC, a Texas limited liability company located at 1009 W Paluxy Rd, Ste E, Granbury, Texas 76048. In these Terms, "we," "us," and "our" refer to All-Star Coatings, LLC. "You" refers to any visitor to the Site.

  1. PERMITTED USE OF THE SITE

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal or business informational purposes. You may not:

  • Copy, reproduce, modify, distribute, or republish content from the Site

  • Sell, rent, sublicense, or commercially exploit any content from the Site

  • Use any automated tool (scraper, bot, crawler) to extract content

  • Reverse engineer, decompile, or attempt to interfere with the Site's operation

  • Use the Site or any contact form to send unsolicited communications, spam, malicious code, or any unlawful content

  • Frame, mirror, or imply any affiliation with us without our written permission

  1. OUR INTELLECTUAL PROPERTY

All content on the Site — including text, photographs of completed projects, logos, marks, designs, and layout — is owned by All-Star Coatings, LLC or used with permission. All rights are reserved.

Project photographs displayed on the Site are our property. They may not be downloaded, copied, or used for any purpose without our prior written permission.

The "All-Star Coatings" name and any associated marks are our trademarks. You may not use them without our written permission.

  1. CONTACT FORM AND INQUIRIES

The Site includes a contact form for submitting inquiries and quote requests. By submitting an inquiry, you confirm that:

  • The information you provide is accurate

  • You have the authority to provide it

  • You are not using the form to send unsolicited commercial offers, harassment, or unlawful content

We will use the information you submit only as described in our Privacy Policy. We aim to respond to inquiries promptly, but we do not guarantee response times through the Site.

  1. NO OFFER OR CONTRACT CREATED THROUGH THE SITE

Information on the Site is provided for general informational purposes only. Nothing on the Site is an offer to perform services, a binding price, or a guarantee of availability.

A binding agreement to perform coating services exists only after both parties have signed a written quote, proposal, or service agreement provided by us. Communication through the Site, including the contact form, does not by itself create a contract.

  1. QUOTES, PROPOSALS, AND SERVICE AGREEMENTS

When we provide a written quote or proposal for coating services, the terms of that document — together with any signed change orders — govern the work. Those documents control over any general statements on the Site if there is a conflict.

Quotes are valid for the period stated on the quote. Pricing, scope, and timelines may change before a quote is signed.

  1. INFORMATION ABOUT COATING SERVICES IS GENERAL

Descriptions of coating products, systems, applications, durability, and performance on the Site are general in nature. Actual recommendations, materials, system specifications, and timelines for any project are provided only in a written quote or proposal after we have evaluated the specific job.

Nothing on the Site is engineering advice, architectural advice, or professional advice for any specific application. For specialized or critical applications (structural protection, regulated environments, food-safe surfaces, secondary containment, etc.), you should consult qualified professionals in addition to consulting us.

  1. COATING PERFORMANCE DEPENDS ON CONDITIONS

The performance, appearance, and service life of any coating depend on factors that include but are not limited to:

  • Condition and preparation of the substrate

  • Existing coatings, contaminants, moisture, and structural integrity

  • Ambient temperature, humidity, and weather during application

  • Compliance with manufacturer specifications

  • Use, traffic, exposure, chemicals, and abrasion after installation

  • Customer maintenance and inspection

We will identify known site conditions and prep requirements in our written quote. Where the customer is responsible for any conditions or maintenance, those obligations will also be identified. We make no warranty regarding coating performance based on the Site, marketing materials, or general descriptions — only the warranty stated in the signed quote, proposal, or service agreement applies.

  1. WARRANTIES FOR COATING WORK

The only warranty that applies to coating work we perform is the express written warranty stated in your signed quote, proposal, or service agreement, if any. To the maximum extent allowed by Texas law, we disclaim all other warranties — express, implied, or statutory — including any implied warranty of merchantability, fitness for a particular purpose, workmanlike construction, or habitability.

  1. WEBSITE PROVIDED "AS IS"

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components, and we do not warrant the accuracy, completeness, or currency of any information on the Site. To the maximum extent allowed by Texas law, we disclaim all express and implied warranties relating to the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

  1. LIMITATION OF LIABILITY

To the maximum extent allowed by Texas law:

  • Our total liability to you for any and all claims arising out of or relating to the Site or our services, regardless of legal theory, is limited to the amount you paid us for the specific project giving rise to the claim — or, if no project exists, one hundred dollars ($100).

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business, or loss of data, even if we were advised of the possibility of such damages.

This limitation does not apply to liability that cannot be limited or excluded under Texas law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by our negligence.

  1. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless All-Star Coatings, LLC and its members, employees, and contractors from any claim, demand, loss, damage, or expense (including reasonable attorneys' fees) arising out of:

  • Your use of the Site in violation of these Terms

  • Your submission of false, misleading, or unauthorized information through any contact form

  • Your violation of any law or third-party right in connection with your use of the Site

  1. THIRD-PARTY LINKS

The Site may include links to third-party websites or services we do not control. We are not responsible for the content, policies, or practices of those sites. Use of any third-party site is at your own risk.

  1. PRIVACY AND COOKIES

Our handling of personal information collected through the Site, and our use of cookies and Google Analytics, are described in our Privacy Policy at www.allstarcoatingstx.com/privacy. By using the Site, you acknowledge that you have read the Privacy Policy.

  1. GOVERNING LAW

These Terms and any dispute arising out of or relating to the Site or our services are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

  1. DISPUTE RESOLUTION — ARBITRATION AND CLASS-ACTION WAIVER

Please read this Section carefully. It affects your legal rights.

a) Informal resolution first. Before starting any formal proceeding, you agree to first contact us at allstar.coatings@yahoo.com and give us at least thirty (30) days to attempt to resolve the dispute in good faith.

b) Binding arbitration. Any dispute, claim, or controversy that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Construction Industry Arbitration Rules, by a single arbitrator. The seat of arbitration shall be Hood County, Texas. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

c) Small-claims carveout. Either party may bring a qualifying individual claim in the Justice Court (small claims court) of Hood County, Texas, instead of arbitration, so long as the claim remains in that court and does not seek class or representative relief.

d) Class-action waiver. All claims must be brought in your individual capacity, not as a class member, collective member, or representative. The arbitrator may not consolidate claims or preside over any class or representative proceeding.

e) Federal Arbitration Act. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

If any part of this Section is found unenforceable, the unenforceable part is severable and the remainder continues in full effect — except that if the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court rather than in arbitration.

  1. ATTORNEYS' FEES

In any proceeding to enforce these Terms, the prevailing party is entitled to recover reasonable attorneys' fees and costs to the extent allowed by Texas law.

  1. FORCE MAJEURE

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including weather, natural disasters, fire, flood, supply-chain disruptions, labor shortages, government actions, utility failures, or pandemics.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Material changes will be posted on the Site for at least thirty (30) days before they take effect. Your continued use of the Site after changes take effect means you accept the updated Terms.

  1. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the rest of the Terms remain in full effect, and the invalid provision will be modified to the minimum extent needed to be enforceable while preserving its intent.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any signed quote, proposal, or service agreement, are the entire agreement between you and All-Star Coatings, LLC regarding the Site and our services, and they supersede any prior or contemporaneous communications.

  1. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a sale, merger, or transfer of our business.
